Store Registration and Certification: We will consider your store registration application and will schedule your store to be shopped and evaluated by an independent Retail Evaluation Service familiar with the juvenile products industry. This process may take approximately 2-4 weeks to complete. Your store must achieve a 70% or higher ranking to be certified and to become listed on the babyproductexperts.com website. After your store achieves this ranking your store information will be added to the find a store section of the Baby Product Experts Website. You will be given a maximum of 2 opportunities to be mystery shopped in order to achieve an acceptable rating.
Payment Terms and Refund Policy: Payments are made online by using Master Card or VISA. There are NO refunds after your store has been shopped and evaluated.
Use of Personal data: Baby Product Experts respects the personal data you give us and we will treat it this data in a responsible ways safeguarding it to the best of our ability. We will not lend, sell or in any other way share this data with any other business or enquiring person. The only times we will reveal your details are 1) If you give us written permission so to do (as in the publishing of citations) 2) If we are required by law to do so. We will not use information we receive from you for any mass marketing either by way of post, telephone, fax or email.
No Warranties: ALL BABY & CHILD MAKES NO WARRANTIES. ALL SALES ARE AS IS.
Limitation of Liability: ALL BABY & CHILD WILL NOT BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, INDIRECT, OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY. YOU AGREE THAT FOR ANY LIABILITY RELATED TO THE PURCHASE OF PRODUCT, ALL BABY & CHILD IS NOT LIABLE OR RESPONSIBLE FOR ANY AMOUNT OF DAMAGES ABOVE THE AMOUNT OF THE SALE PRICE FOR THE APPLICABLE SERVICE OR PRODUCT. NOTWITHSTANDING ANYTHING IN THIS AGREEMENT TO THE CONTRARY, THE REMEDIES SET FORTH IN THIS AGREEMENT SHALL APPLY EVEN IF SUCH REMEDIES FAIL THEIR ESSENTIAL PURPOSE.
Governing Law: THE PARTIES AGREE THAT THIS AGREEMENT, ANY SALES THERE UNDER, OR ANY CLAIM, DISPUTE OR CONTROVERSY (WHETHER IN CONTRACT, TORT, OR OTHERWISE, WHETHER PREEXISTING, PRESENT OR FUTURE, AND INCLUDING STATUTORY, CONSUMER PROTECTION, COMMON LAW, AND EQUITABLE CLAIMS) BETWEEN CUSTOMER AND ALL BABY & CHILD arising from or relating to this sale, or the interpretation of any agreement, or the breach, termination or validity thereof, the relationships which result from this agreement, ALL BABY & CHILD'S advertising, or any related purchase SHALL BE GOVERNED BY THE LAWS OF THE STATE OF TEXAS, WITHOUT REGARD TO CONFLICTS OF LAW.
